The State Legislature is responsible for creating both plans which must then be approved by the Governor. If the legislature fails to create a redistricting plan, an eight member commission is appointed by the Majority and Minority leaders of the House with a ninth member chosen by lottery from the names of a Republican and a Democrat submitted by the state Supreme Court. The Governor has veto power over both congressional and state legislative district plans.
